Wine Delivery Terms and Conditions

[I] General

Alcohol beverages are only available to customers aged 18 or above. A person aged 18 or above (identification required) must be present to take delivery or delivery shall be withdrawn and attempted at another time agreed.

Breakage

The Customer is requested to examine the goods immediately upon delivery for any deficiencies and/or damages. Claims (if any) must be lodged to ordered store at the time of delivery, otherwise we shall have the discretion to refuse your claim after delivery.
It is the receiver’s responsibility to check the condition of goods at the time of delivery, refund is not available for all delivered goods under normal circumstances.

[II] Delivery *

We offer FREE wine delivery for wine purchases over HK$1,000 nett. For wine purchase under HK$1,000 nett, a delivery charge of HK$100 shall apply. Offer limited to single receipt, one location and valid only on the day of purchase.
The delivery service is available from Monday to Saturday between 09:00am and 7:00pm, within 5 working days from the date of order (Ma Wan delivery is restricted to Monday to Saturday between 10:30am-3:00pm,).
Customers can also nominate a delivery date (excluding public holidays) free of charge. Nominated day delivery applies only to orders available at purchasing store or warehouse if delivery date less than 5 days from the date of order (cut off before 3pm on working days)
“Next day delivery” is only applicable for orders received on Monday to Friday between 9:00am and 3:00pm.
Deliveries are available to all districts of Hong Kong. (Except for outlying islands) • HK$40 toll will be charged on all deliveries to Tung Chung, Airport and Ma Wan – only restricted to Park Island and Tin Liu New Village. And HK$170 toll will be charged on all deliveries to Discovery Bay.
It is the responsibility of the customer to notify Marks and Spencer immediately of any change to their delivery address.
Delivery will be suspended if black rain signal/ typhoon signal No. 8 or above is hoisted.
We reserve the right to decline delivery of goods to any customer at our sole discretion absolutely.
According to Full Implementation of the Plastic Shopping Bag Charging (PSB Charging) by Environmental Protection Department effective from 1 Apr 2015, if customer requests to include any Marks and Spencer wine bag in the delivery, the charge is HK$0.5 each.
Orders received on Saturdays between 9:00am and 3:00pm will be delivered on the next working day
Orders received on public holidays will be delivered the day following the next working day.
In case of Non-pickup / non-delivery
We reserve the right to charge an additional delivery fee if the recipient is not available to accept delivery at the nominated delivery time.
The Company has the right to charge storage fees for storing the wine in the event that:

a customer fails to pick up the wine within two weeks of purchase.
wine is non-deliverable within two weeks of purchase due to customer’s failure to notify the Company of change of address or the Company is otherwise unable to contact customer.
a customer refuses to take delivery of the wine.

In the event that the wine has not been collected / cannot be delivered and the storage fees referred to above have not been paid for 1 year from notification by the Company that the wine is ready, then the Company has the right to dispose of the wine with no further notice to the Customer. The Company shall have no liability to the customer in respect of disposal of the wine in such circumstances. These terms and conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People’s Republic of China and the Customer and Marks and Spencer (Asia Pacific) Limited agree to submit to the exclusive jurisdiction of the Hong Kong courts. Marks and Spencer (Asia Pacific) Limited may revise these terms and conditions at any time without prior notice. If any dispute arises, Marks and Spencer (Asia Pacific) Limited’s determination shall be final. Where these terms and conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.

洋酒送貨服務條款及細則:

• 酒精類飲品只供應予18歲或以上的人士。倘若送貨物品內包括酒精類飲品，必須由一名年滿18歲或以上人士(須提供適當證明)收取該等貨品。如上述人士並不在場，本公司有權收回貨品並會嘗試於另一約定時間再行送貨。

貨物破損

顧客於收取貨品時必須檢查所訂購之貨品是否有損毀。如發現貨品損毀，請立即通知訂貨店鋪安排更換貨品。本公司有權拒絕更換已簽收之貨品。
當收貨人士收取已訂購之貨品的同時，有責任檢查該貨品是否有損毀情況，一般情況下所有已送貨的洋酒均不設退換。.

[II] 送貨服務*

凡購買洋酒滿淨值價HK$1,000或以上，即可享免費送貨服務 (只適用於當日之單一發票及單一送貨地址)。惠顧洋酒低於淨值價HK$1,000，此送貨服務費為HK$100。
送貨時間為星期一至星期六早上9時至晚上7時，訂購當日起計5個工作天 (馬灣送貨時間只限上午10:30至下午3:00)。
顧客亦可免費「指定送貨日期」(公眾假期除外)。如指定送貨日期為訂購後 (以下午3時前的工作天計起) 5天內送貨，必需確認購買分店或貨倉可提供全單之貨品。
「翌日送貨」服務只適用於逢星期一至星期五早上9時至下午3時所收到的訂單。
送貨服務適用於全香港(離島除外)。.
東涌、機場及馬灣 – 只限於珀麗灣及田竂新村，需附加HK$40通行費;愉景灣需附加HK$170通行及隧道費。.
送貨地址如有任何變更，顧客有責任即時通知本公司。.
如遇上黑色暴雨警告/八號或以上颱風訊號，當日之送貨服務將會暫停及另作安排。
本公司保留權利可絕對酌情決定拒絕向任何顧客送付貨品
根據環境保護署於2015年4月1日實施的全面推行塑膠購物袋收費 (「膠袋收費」) ，顧客如要求送貨時附上任何Marks & Spencer酒袋，每個收費為港幣$0.5。
星期六早上9時至下午3時的訂單將於假期後的第1個工作天送貨
星期日及公眾假期收到的訂單可安排於假期後的第2個工作天送貨。

沒有提取/不成功派送

如收貨人士未能於約定時間內收取已訂購之貨品，本公司將保留權利向該顧客收取額外的送貨費用。
• 本公司有權於下列情況收取藏酒費用:

顧客沒有提取已購買之葡萄酒達兩星期;
由於顧客沒有通知本公司更改地址或本公司不能成功聯絡顧客，而未能成功派送葡萄酒達兩星期;
顧客拒絕接收已派送之葡萄酒。

本條款將按照中華人民共和國香港特別行政區(「香港」)法律詮釋及受香港法律所管轄。而本條款每個部分的應用僅限於該法律所允許的程度。若本條款內有任何部分在任何司法管轄區被禁止或無法執行，只有被禁止或無法執行的部分在該司法管轄區宣告無效，但不會使本條款其餘部分無效或該部分在其他司法管轄區的有效性、合法性或可執行性均不會受到影響。Marks and Spencer (Asia Pacific) Limited保留權利，可按其絕對酌情權修改本條款及條件。如有任何爭議，Marks and Spencer (Asia Pacific) Limited保留最終的決定權。本中文譯本僅供參考之用，倘若中、英文本之文義有異，應以英文原文為準。
